GENERAL TERMS AND CONDITIONS OF GITARREN TOTAL
1. Geltungsbereich & Vertragspartner
1.1. These General Terms and Conditions (GTC) apply to all orders, sales contracts, and services provided through the online store, as well as to purchases made at the retail store of:

(hereinafter referred to as “Seller” or “we”).
1.2. A “customer” refers to any natural or legal person who enters into a business relationship with the provider.
1.3. Any terms and conditions of the customer that differ from these will not be recognized unless the provider has expressly agreed to their validity in writing.
2. Offer and Agreement
2.1. In-Store Purchase
The sales contract is concluded in the store upon delivery of the merchandise and payment at the register.
2.2. Purchase in the Online Shop
- By clicking the “Place Order” button, the customer submits a binding order for the items in the shopping cart.
- The contract is concluded upon receipt of the automatic order confirmation via email.
3. Prices and Shipping Costs
3.1. All prices listed are in Swiss francs (CHF) and include the applicable VAT.
3.2 Price comparisons are based on the manufacturer’s suggested retail price (MSRP).
3.3. We ship within Switzerland and internationally.
3.4. Free Shipping Order Value: For orders of CHF 40.00 or more, shipping within Switzerland is free. For orders under CHF 40.00, a minimum order surcharge of CHF 7.00, as shown during the checkout process, will be applied.
3.5. Shipping costs to other countries are calculated on an individual basis. Swiss VAT is deducted from the item price. Additional costs (import fees, customs duties, VAT in the country of import) may apply to orders placed from abroad.
3.6. Prices are subject to change, and errors may occur.
4. Terms of Payment, Delivery, and Retention of Ownership
4.1. Customers can choose from the payment options listed during the ordering process or at checkout.

4.2. Purchase on invoice / advance payment: The ordered goods will be shipped only after the full invoice amount has been credited to the seller’s account.
4.3. Retention of ownership: The delivered goods remain the property of the seller until all claims have been paid in full.
5. Obligation to Inspect and Notice of Defects
5.1. The customer is required to inspect the delivered or picked-up goods immediately upon receipt to ensure they are complete and free of visible defects.
5.2. Any defects or discrepancies must be reported to the seller in writing (by email) within 7 days of receipt of the goods. Hidden defects must be reported immediately upon discovery. If no complaint is filed, the goods are deemed to have been accepted.
6. Warranty
6.1. The standard warranty conditions under the Swiss Code of Obligations (OR) apply. The warranty period is 2 years from the date of purchase or delivery. Consumables such as tubes, speakers, or strings are excluded from the warranty.
6.2. The seller may, at its discretion, fulfill warranty claims by repairing the item, providing an equivalent replacement, or reducing the purchase price.
6.3. Damage caused by improper use, normal wear and tear, lack of maintenance, or external factors is excluded from the warranty.
7. Returns
7.1. Delivered goods will only be taken back if this has been agreed in advance, the goods and the original packaging are in perfect condition and the return is carriage paid to the registered office in Zurich. Bei ohne Einverständnis zurückgesandter Ware behält sich der Anbieter vor, die Annahme zu verweigern. In the case of goods which have been manufactured at the special request of the customer or which have been specially ordered because they are not customary in stock, a return is excluded.
8. Limitation of Liability
The seller is liable for damages only in cases of willful misconduct or gross negligence. Liability for slight negligence, indirect damages, or consequential damages (e.g., lost profits) is excluded.
9. Privacy Policy
We store your address information in accordance with legal requirements and keep it confidential. This information includes only order-related data and your areas of interest, so that we can provide you with the right information about special offers, new products, or events.
10. Applicable law and place of jurisdiction
The exclusive place of jurisdiction for all disputes is Zurich, Switzerland.
